What Happen to My Inheritance?




I’ve been asked to start a blog to talk about generational inheritance issues. In doing so, I want to hear your stories also. At times it might get very emotional as we express our stories. There appears to always be a fight when it comes to wealth transfer. Why? Stay tuned to hear my take on it. But for now, from the beginning of time we have had to fight for what belongs to us. Being denied the right of ownership and to possess which includes passing down the inheritance to the next generation. Should leave one to question "what happen to my inheritance." The answer lies not just with our immediate experiences but it goes back in time to where for example my native-American roots lies. We as a people of color are already behind the eight ball when it comes to generational wealth being passed down. But when you have an outside force that's allowed to walk away with your inheritance causing the transfer to be transferred else where. We should be up and arms pursuing what belongs to us. And how to go about getting it back. So I'll start the share with my story. Here goes!!!

My father died in September of 2008. To this day words cannot express just how much I miss him. Months before his death he called for me to come and help him with putting his (legal) house in order.  So, I dropped my world in-exchange for his and began to pursue the demand that the Holy Spirit was placing on me to get this done. I had to rise to the occasion and begin to fight for what was being left behind belonging to my siblings and myself. I didn't know that I had to fight alone. Everybody was for themselves. Hiding conversations being had with my Father.  Relatives claiming things. WOW!!! This had become a nightmare. Right now, the family is split and the generational spirit of offense which followed our family from generation to generation was now back in full effect. It takes one open door to allow the enemy inside and this was the door. Where we are or should I say where I am is looking for justice in legal system. I'm so glad that its unfolding the way it is because generally if you have a "trust" there's know worries of who should get what. In this case, I witnessed my Father being "euthanized" and I prayed that the incident would be heard before a Judge who would listen. So, its a good thing the case I originally filed is in the court system. It's also a good thing that I'm a Superior Court Mediator. It has afforded me and empowered me with the opportunity to represent myself. I also must admit that my contract and negotiation skills and knowledge gained from interning for a Litigation Attorney makes this particular court battle mere practice for me. However, you and I know that legal advice is needed when its beyond your scope. One last thing on this subject. 
My father the business owner since I was a little girl and know doubt before birth appeared savvy enough to insure that just in case something were to happen to him we his only off-spring would at lease be well protected against outside forces who also saw inherited wealth as theirs. I just could not wrap my mind around how his only sibling’s on the planet could be in-tangled and fighting for what rightfully belongs to us. Let me go one step further. How can someone of 10 years commit euthanasia and walk off with 80% of our inheritance? Sounds familiar? Let’s talk about.      “Just Ask G”

    1. You have started a great topic here. One that I have debated with friends and associates in the financial industry. It never ceases to amaze me how "siblings and or family" dispute property and/or contest wills. That is if there was a "will or living trust" set up. Even with the economy as it is today in regards to the real estate market. I believe that a portfolio that includes property is essential. In fact, I believe that handing down property (family homes and businesses) is one of the top ways to build wealth and a financial foundation for wealth.

      On a personal note, growing up we always had two homes. One for business one to live in. Our parents always stressed that "one day this will be yours"....well there are six children in our family...and then....

  2. Yes, Lexa I agree. and then..... This is truly a topic of discussion that need to be addressed. Family feuding over what's left behind. We must take a closer look at the bigger picture and view inheritance from the vantage point of being a rightful heir of the families generational legacy and keeping the legacy in the blood family.   3. Hey Everybody,

    I tell you I've been so busy and my schedule has more than doubled in terms of projects. It's time to hire some administrative help. Mean while I had to dismiss my Superior Court inheritance and wrongful death case, yesterday. I dismissed (with-out) prejudice, which means I can file at a later date. I spent most of my day on the phone, online, and by the fax machine. First, I had to contact the courts email and fax the judge. Next I had to file forms online through Nexis and notify the defendant Attorney's followed by more faxing. I find myself going to court at-least every three months or so. It's very time consuming. Basically it becomes a project. No doubt this is why we hire lawyers. My particular case is Asbestos related and involves up-to 15 employers. Also, because I'm so passionate about walking in on my dad being held down and given morphine in his breathing equip without a Doctors prescription or approval to do so, there is more generational wealth at stake in terms of heir inheritance and the transference of it. I don't know if it was the right move but certainly at this time I'm so counting on the Holy Spirit to continue to order my steps every step of the way. The trust account has been divided unequal thus far however, future deposits are also a great concern. So, let's just see down the road how making such a decision unfolds. But before you decide to do the same, make very sure that you get legal advice. Even-though I know my way around the court room and know what legal forms to self file, I always get a second opinion. In the mean time. I do want to hear your stories.
